Blooms Flowers Terms and Conditions
The SellerThe Seller is Flowers Direct Online Ltd. Registered in England at Companies House No. 04249814. VAT Reg. No. 918 0725 53. Registered Office Anchor Building, Westgate, Morecambe, LA3 3DD. Flower ServiceThese terms apply to flowers ordered by Internet through Blooms Flowers website. Internet offers relate to Internet transactions only and may not be available in store. Likewise (temporary and local) promotions and offers in store do not apply to Internet prices. Order Acknowledgement and AcceptanceFor your order to be processed and delivered on the required date, you must supply us with all the relevant details of the recipient including full delivery details, post code and telephone number. Your order will only be processed if full payment details are given. Your order will be acknowledged via e-mail confirming your details, if you enter a correct e-mail address, on the understanding that delivery is subject to availability. You will also be issued an order reference number for any future correspondence. Acceptance of the order will take place on the allocation of the goods to your order. PaymentPayment may be made by any of the methods indicated on the flowers payment page and will be debited when you place your order. If any credit or debit card offered for payment is declined by the card provider, we will make every effort to contact you on the number given at the time of ordering for an alternative form of payment. If, for whatever reason, we are unable to contact you and an alternative form of payment is not provided, the order will be cancelled. You will be charged the current price for buying goods from our website at the date you place your order. All prices are displayed on our website and are inclusive of VAT. We do our best to make sure that prices are correctly shown, but very occasionally an error may occur due to systems failure. If this should happen or the VAT rate changes, we will correct the price and ask you to confirm whether or not you wish us to complete your order. ProductsWe reserve the right to change all or some of the contents or packaging to provide an item of equal or greater value without notice. All products are subject to availability. Products may be delivered in bud to ensure longer life. Bouquet contents may be: harmful if eaten; a skin irritant - please contact us on 0845 150 1500 if you require further information before submitting an order. In the event that we are unable to supply the product or any substitute product to you at all, we shall notify you as soon as is reasonably possible and shall reimburse your payment in full and in any event no later than 30 days after the intended delivery date. PricesPrices include VAT charged at the current UK national rate. A service/delivery charge of £3.99 will be added to your order for deliveries anywhere on mainland UK. When ordering flowers and a gift (bears, chocolates and balloons) together only one £3.99 service/delivery charge will apply. DeliveryThe service/delivery charge is payable per delivery address, per transaction. We aim to deliver flowers where possible, on the day you request. A standard service/delivery charge of £3.99 will be added to your order for all floral deliveries to all addresses on mainland UK. Customers who request delivery in a remote rural area will be advised prior to delivery of any increased delivery charges. Purchases of products containing alcohol can only be made and be received by persons of 18 years or over. Any such purchases should be made by credit card. We reserve the right to refuse any sale at our discretion. Same day delivery is normally available (Monday to Saturday) for orders received no later than 2.30pm GMT to recipients in mainland UK when ordering from the Same Day Range of flowers. The Next Day range, Designer range and Gifts are available for next day delivery, Tuesday to Saturday, for orders received by 3.30pm GMT (Monday to Friday). There are no deliveries on a Monday from these ranges. The Sympathy range of flowers can usually be delivered Monday to Saturday where orders are received the previous day, no later than 2.30pm GMT. Flower deliveries will not normally be made on a Sunday or on UK public holidays. Please contact us by telephone (0800 652 0636) if you require a delivery at these times to see whether it is possible for us to make a special delivery. We do not guarantee any delivery times unless the order is for a funeral, in which case these orders will be delivered in good time, normally 1-2 hours before. We will always try to adhere to your requested am or pm preference wherever possible but this is only a preference and is not a guarantee. We deliver all orders between 8am and 8pm. We do endeavour to deliver before 5pm, especially in the case of birthdays, anniversaries and for deliveries to business addresses. However, we are unable to specify an exact delivery time. Occasionally we may be unable to deliver due to non-availability of stock or unforeseen circumstances. If such a problem arises we will issue you with a refund of any payment made. This will discharge any liability for failure to deliver your order. Whilst we make every effort to deliver your goods on your specified delivery date, we cannot be held responsible if we are unable to do this due to circumstances beyond our control. If you are not completely satisfied with your bouquet please call our Customer Services, within 48 hours of delivery on 0845 150 1500, quoting your order reference number. Blooms trades inline with the new European Directive on distance selling which is incorporated into UK law by The Consumer Protection (Distance Selling) Regulations 2000. GeneralThe reproduction of colours of our products is as accurate as the photographic and production process will allow. All matters concerning and incidental to any offer or agreement for the purchase and sale of goods from our website shall be in English and construed and governed according to English law and the English courts shall have jurisdiction in all such matters. CancellationThe customer has the right to cancel an order for wine, Champagne, and other non-perishable goods within 7 days after placing the order without giving a reason. All perishable Next Day delivery goods may only be cancelled up until 12PM on the date prior to delivery. The cancellation period in the case of contracts for the supply of goods begins with the day on which the order contract is concluded. The cancellation period ends on the expiry of 7 working days from the day that the recipient receives the non-perishable goods. The consumer is entitled to a cooling off period of 7 days during which they may cancel their order for any reason. The consumer can be asked to return the goods and will not be charged for returning them. Where the customer exercises their right to cancel, we will return their money to their account within 30 days of cancellation. Orders for Same Day UK delivery may be amended or cancelled up to 24 hours before the intended delivery date. Orders placed for Next Day delivery and for an International delivery may be amended or cancelled up to 48 hours prior to the intended delivery date. To amend or cancel your order, please contact the Blooms Customer Service Team. Our offices are open from 8am until 6:30pm Monday to Friday 9.00am to 5.00pm on Saturday.
